1. Agreement to Terms

By accessing and using TharCloud's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily access the services provided by TharCloud for personal or commercial use. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose without proper authorization
• Attempt to reverse engineer any software contained on TharCloud's services
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. Services Description

TharCloud provides cloud infrastructure solutions, DevOps services, machine learning and AI solutions, and related consulting services. We reserve the right to modify, suspend, or discontinue any aspect of the services at any time without notice.

4. User Obligations

As a user of our services, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account
• Comply with all applicable laws and regulations
• Not engage in any activity that interferes with or disrupts our services

5. Payment Terms

For paid services, you agree to pay all fees and charges according to the billing terms in effect at the time the fee or charge becomes payable. All fees are non-refundable unless otherwise specified in writing or required by applicable law.

6. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of TharCloud and its licensors. The service is protected by copyright, trademark, and other laws of both India and foreign countries.

7. Service Level Agreement

We strive to maintain high availability of our services. Specific SLA terms, including uptime guarantees and remedies, are detailed in individual service agreements. We do not guarantee uninterrupted or error-free service.

8. Limitation of Liability

In no event shall TharCloud, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.

9. Indemnification

You agree to defend, indemnify and hold harmless TharCloud and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the service.

10. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of courts in Rajasthan, India.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
